Welcome to Phone Friday (the "Service"), owned and operated by Techlosophy, LLC ("we," "us," or "our"). By accessing or using our website at phonefriday.com and our telephony services, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

1. Description of Service

Phone Friday provides business telephony management tools, including inbound and outbound call routing, IVR call menus, and text messaging (SMS/MMS). The underlying telecom networks are powered by third-party provider Twilio.

2. Account Registration and Access

• Passwordless Security: You access your account via passwordless authentication tokens ("tickets") delivered to your phone via SMS. You are entirely responsible for maintaining the privacy and security of your personal SMS messages, and the tickets sent by Phone Friday.
• Accuracy of Information:You agree to provide current, accurate registration info (name, phone number, and optionally email address).
• Account Termination: We reserve the right to suspend or terminate accounts that provide false info or breach these Terms.

3. Text Messaging (Including Marketing from Techlosophy, LLC)

You agree to receive automated promotional messages to the phone number you provide to us. This agreement is not a condition of any purchase.

We may send up to 5 marketing messages per month.

You may opt out of promotional text messages at any time by replying STOP.

You agree we can send you transactional text messages, such as notifications of invoices, incoming calls to your business number, and any messages required to provide our service to you.

There is no limit to the amount of transactional text messages we may send you - it is dependent on the amount of calls your business number receives

4. Acceptable Use and Carrier Compliance

You agree to use Phone Friday strictly for lawful business purposes. We maintain a zero-tolerance policy for service abuse.

Prohibited Activities - You are strictly prohibited from using Phone Friday for:

• Illegal Robocalling & Spam: Transmitting automated, unsolicited telemarketing calls or SMS spam.
• Spoofing: Altering caller ID information to deceive or mislead recipients.
• Phishing & Fraud: Impersonating other companies, financial institutions, government agencies, or individuals.
• Harassment: Stalking, threatening, or transmitting explicit or defamatory communications.

Carrier & Twilio Rules - Because our system relies on the Twilio API, you must comply with all standard carrier rules, federal FCC regulations, and local laws (such as the Telephone Consumer Protection Act - TCPA). Failure to follow carrier messaging compliance (including mandatory opt-in/opt-out rules for SMS) will result in immediate termination of your service without a refund.

5. Subscriptions, Billings, and Carrier Fees

You may make payments via our third party payment provider (https://stripe.com) which will add to your Phone Friday account balance. Some parts of Phone Friday's service are billed on a pay-as-you-go basis, while other recurring charges may be billed on a monthly billing cycle.

• Stripe Processing: All payment processing is securely handled via Stripe. By activating a subscription or depositing phone credits, you authorize Stripe to charge your designated payment method.
• Pay-as-you-Go Billing: Billing reduces the balance in your Phone Friday account shortly after each call or SMS.
• Monthly Billing: Billing reduces the balance in your Phone Friday account. A monthly billing date is established for each customer phone number. Monthly billing for each number will occur on or near its billing date.
• Phone Friday Fees: Charges for numbers, minutes, and outbound SMS are deducted according to our current rate sheet. Billing (either pay-as-you-go or monthly) reduces the balance in your Phone Friday account. Techlosophy, LLC, in its sole discretion and at any time, may modify the fees for the available services. Techlosophy, LLC will provide you with a reasonable prior notice of any change in service fees to give you an opportunity to terminate your account before such change becomes effective. Your continued use of the Service after a service fee change comes into effect constitutes your agreement to pay the modified service fee amount.
• Termination of Service If/when your Phone Friday account balance reaches $0, Phone Friday will cease to provide you services until you make payment to return to a positive account balance. One way to terminate your Phone Friday service is to simply let your account balance fall to $0.
• Notification Threshold You will be able to set a notification threshold, and if your account falls below that threshold value, Phone Friday will send you a notification of the low account balance.
• No Refunds: Except as evaluated on a case-by-case basis at the sole discretion of Techlosophy, LLC or legally required, all service fees and credit deposits are strictly non-refundable.

6. Affiliate Program Terms

If you participate in the Phone Friday Affiliate Program, you agree to the following tracking and payout rules:

• Valid Referrals: Credits or monthly commissions are generated only from valid accounts that register using your authentic affiliate tracking link.
• No Self-Referrals: You may not use your own affiliate link to create separate accounts for yourself.
• Payout Modifications: Techlosophy, LLC reserves the right to modify commission rates, credit conversions, or payout schedules at any time upon notice.

7. Limitation of Liability and Service Disclaimers

In no event shall Techlosophy, LLC, nor its officers, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

• "As-Is" Service: Phone Friday is provided on an "as-is" and "as-available" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
• Telecom Interruptions: Techlosophy, LLC is not liable for upstream service outages, network downtime, dropped calls, or failed SMS deliveries caused by Twilio or cellular carrier networks.
• No Emergency Services: Phone Friday is not a replacement for traditional phone lines and CANNOT be used to dial emergency services (such as 911). You must maintain alternative means of making emergency calls.
• Third Parties: Techlosophy, LLC has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

8. Governing Law

These Terms and any disputes arising out of your use of the website or service shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

9. Modifications to Terms

We reserve the right to update these Terms at any time. We will indicate changes by updating the "Last Updated" date at the top of this document. Continued use of Phone Friday after updates are published constitutes your acceptance of the revised Terms.
